Speaker Bagbin: The Supreme Court ruling makes some elected MPs ineligible to be sworn in

Accra, December 29, GNA – Speaker of Parliament, Mr. Alban Bagbin, has declared that parliamentary candidates whose results were annulled by the Supreme Court on Friday, December 27, 2024, cannot be sworn in as Members of Parliament on January 6. , 2025.

This decision followed the High Court’s annulment of the re-collected results for the Okaikwei Central, Ablekuma North, Tema Central and Techiman South constituencies due to irregularities in the process.

Mr Bagbin made this known on Saturday when the Professionals Forum (ProForum) of the National Democratic Congress (NDC) honored him with a citation in recognition of his outstanding contributions to democracy, governance and development in Ghana.

ProFroum, is an activist group of the NDC.

The NDC had challenged the Supreme Court decision directing the Electoral Commission to re-collect parliamentary election results in nine disputed constituencies. The NDC argued that the rescheduling process was unlawful and of no merit, stating that the court had exceeded its jurisdiction.

In his remarks, Speaker Bagbin emphasized that the Supreme Court ruling supported his position and stated that the statement of the concerned elected MPs was illegal.

He clarified that to become an MP, one must be elected by the voter, declared by the Electoral Commission and sworn in by the Speaker.

“…They remain elected members of parliament until sworn in. Some recasts and new declarations were null and void, unknown to the law and therefore ineligible to be sworn in by me,” he said.

Reiterating his commitment to upholding the law, he said, “I am the gatekeeper. The right thing must be done for Ghana to reset,” he said.
