PepsiCo Drops Plastic Pollution Liability Case in New York (1)

PepsiCo Inc. has not polluted New York State’s Buffalo River and cannot be held responsible for the river’s plastic pollution, a state judge ruled in a harsh rebuke to Attorney General Letitia James (D).

James’s “phantom claims” seeking to hold Pepsi liable for pollution from its products “do nothing to solve the pollution problem,” Supreme Court Justice Emilio Colaiacovo said in his dismissal of the trial that was pronounced on Thursday.

The legal system should not be “burdened with predatory lawsuits that aim to impose punishment while a crime is being sought,” Colaiacovo wrote.
